15.04.010 International Building Code 2003 - Regulations Adopted and Modified.

The provisions of Chapters 2 through 35, inclusive, of the 2003 International Building Code issued by the International Code Council, Inc., 4051 West Flossmoor Road, Country Club Hills, IL, 60478, not less than three (3) copies of which have been and are on file in the Office of the Clerk of the City of St. Charles, Illinois, for more than thirty days, together with the amendments listed in Section 15.04.015 hereof, are hereby adopted as the regulations governing the construction of buildings and structures within the City of St. Charles, except for one- and two-family dwellings and townhouses not more than three stories in height, which are covered by Section 15.04.020. (For adoptions of administrative provisions in Chapter 1 of the International Building Code, see Chapter 15.101). (Ord. 2004-M-62 § 1.)

15.04.015 Amendments to the 2003 International Building Code.

1. Amend Section 202 “Definitions” (pg. 11) by adding the following:

Townhouse: A single family dwelling unit constructed in a group of 3, 4, 5, or 6 attached units in which each unit extends from foundation to roof and with open space on at least two (2) sides. Dwelling units where more than six (6) units are attached shall be governed by code provisions applicable to multiple family dwellings, rather than the provisions of this one (1) and two (2) family dwelling code.

2. Delete the provisions of Section 402.4.2 “Number of Means of Egress” (pg. 39) and substitute the following therefor:

402.4.2 Number of Means of Egress: Each tenant space shall be provided with two (2) exits remote from each other. One (1) exit may discharge into the mall, the other into a separate remote, protected exit way. Where the tenant space has an occupant load of less than twenty (20) persons, based on the size of the tenant space, and the travel distance from the mall exterior entrance to the remote point within the tenant space does not exceed 150 feet, a secondary exit is not required.

3. Amend Section 402.11 “Security Grills and Doors” (pg. 41) by adding Note #5 as follows;

5. A security grill may not serve as the sole exit.

4. Delete the provisions of Section 402.9 “Smoke Control” (pg. 41) and substitute the following therefor:

402.9 Smoke Control: A ventilation system shall be provided that is capable of not less than six (6) air changes per hour for the volume of the tenant spaces and the mall. The ventilation system shall exhaust smoke from the point of development. Design shall be in accordance with Section 909, as amended.

5. Amend Section 403 “High-Rise Buildings” by deleting Section 403.1 “Applicability” (pg. 41) and 403.2 “Automatic Sprinkler System” (pg. 42) in their entirety and substitute the following therefor:

403.1 Applicability: The provisions of this section shall apply to all buildings having occupiable floors located more than thirty-five (35) feet above the lowest level of Fire Department vehicle access.

6. Delete the provisions of Section 404.3 “Automatic Sprinkler Protection” (pg. 43) and substitute the following therefor:

404.3 Automatic Sprinkler System: The atrium and all stories and floor areas connected to the atrium shall be equipped throughout with an automatic sprinkler system in accordance with Section 903. The automatic sprinkler system shall be supervised in accordance with Section 907.14, Method 1, or 2.

7. Amend Section 406.2 “Parking Garages” (pg. 45) by adding paragraph Section 406.2.10 “Sprinkler System” as follows:

406.2.10 Sprinkler System: All parking garages shall be equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1 – NFPA 13 System.

8. Amend the provisions of Section 407 “Group I-2” (pg. 48) by adding Section 407.8 “Smoke Control System” as follows:

407.8 Smoke Control Systems: A smoke control system shall be installed for all I-2 uses in accordance with Section 909.

9. Delete the provisions of Section 411.1 “General” (pg. 53) and substitute the following therefor:

411.1 General: All special amusement buildings shall comply with the requirements for the appropriate Group A occupancy and this Section.

10. Delete the Exception paragraph of Section 411.4 “Automatic Sprinkler System” (pg. 53) in its entirety.


11. Delete the Exception paragraphs of Section 413.2 “Attic, Under-floor and Concealed Spaces” (pg. 55) and substitute the following therefor:

12. Delete the provisions of Section 415.1 “Scope” (pg. 59) in its entirety, and substitute the following therefor:

415.1 Scope. The provisions of this section shall apply to all storage and use of hazardous materials. The uses described as High Hazard Uses in Use Groups H-1, H-2, H-3 and H-4 are not permitted uses except by specific approval of the Building Official and the Fire Chief on a case-by-case basis. Such approval shall be based on an analysis of the products, processes, and applications involved and on the criteria listed in this section and in Exhibit A.

13. Delete the provisions of Section 416.1 “General” (pg. 71) in its entirety and substitute the following therefor:

416.1 General. The provisions of this section shall apply to all construction, installation and use of buildings and structures, or parts thereof, for the spraying of flammable paints, varnishes, and lacquers or other flammable materials or mixtures or compounds used for painting, varnishing, staining or similar purposes. Such applications of flammable finishes are not permitted uses except by specific approval of the Building Official and the Fire Chief on a case-by-case basis. Such approval shall be based on an analysis of the products, processes, and applications involved and on the criteria listed in this section and in Exhibit A.

14. Delete the provisions of Section 417.1 “General” (pg. 72) in its entirety and substitute the following therefor:

417.1 General. Drying rooms are not a permitted use except by specific approval of the Building Official and the Fire Chief on a case-by-case basis. Such approval shall be based on an analysis of the products, processes, and applications involved and on the criteria listed in this section and in Exhibit A.

15. Delete the provisions of Section 418.1 “Building Features” (pg. 72) in its entirety and substitute the following therefor:

418.1 General. The manufacturing of organic coatings is not a permitted use except by specific approval of the Building Official and the Fire Chief on a case-by-case basis. Such approval shall be based on an analysis of the products, processes, and applications involved and on the criteria listed in this section and in Exhibit A. In addition, manufacturing of organic coatings shall be done only in buildings that do not have pits or basements.

16. Delete Table 503 “Allowable Heights and Building Areas” (pg. 74) in its entirety and substitute the following therefor:

17. Delete Exception No. 3 of Section 504.2 “Automatic Sprinkler Increase” (pg. 75) in its entirety.

18. Delete Exception No. 2 of Section 505.3 “Egress” (pg. 75) and substitute the following therefor:

2. Accessible means of egress shall be provided in accordance with Section 1007.1 (pg. 197).

19. Delete Exception No. 2 of Section 506.3 “Automatic Sprinkler Increase” (pg. 76) in its entirety.

20. Amend the provisions of Section 506 by adding Section 506.5, as follows:

506.5 Special Restrictions for Type V Construction: Notwithstanding any provisions of this code to the contrary, there shall be no increase of the allowable areas specified in Table 503 for any building of Type V-A or Type V-B Construction. Floor areas greater than those specified in Table 503 are only permitted for Type V construction when a four hour firewall is provided between sections of the building, and each section is within the limitations of Table 503. A minimum separation of 30 feet shall be provided between exterior walls of type V construction.

21. Delete the provisions of Section 507.1 “Non-sprinklered, One Story” (pg. 76) and substitute the following:

507.1 One Story Buildings: For all occupancies other than Use Groups A-1, A-2, A-4, A-5, E, H, I-1, I-3, and R, the area of the buildings that do not exceed one story and 85 feet in height, other than buildings of Type 5 construction, shall not be limited, provided that the building is equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1, (pg. 168); and the building is separated as specified in Table 602 (pg. 83) as amended. Buildings with occupancy in Use Group I-1 shall not be constructed of Type 3B construction.

22. Delete Table 602 “Exterior Walls and Fire Separation Distance” (pg. 83) and substitute the following therefor:

25. Delete the provision in Section 705.3 “Materials” (pg. 90) in its entirety and substitute the following therefore:

705.3 Materials: Fire walls shall be constructed of approved masonry materials.

26. Delete Table 705.4 “Fire Wall Fire Resistance Rating” (pg. 90) and substitute the following therefor:

27. Delete Exceptions 1 and 2 under Section 708.3 “Fire Resistance Rating” (pg. 95) in their entirety.

28. Delete the provisions in Section 903.2 “Automatic Sprinkler Systems – Where Required,” inclusive of subsections 903.2.1 through 903.2.13 and Table 903.2.13 and substitute the following therefor:

903.2 Where Required. An automatic fire suppression system shall be installed and maintained in full operating condition throughout every story and basement of all buildings subject to this code.

Exception: An automatic fire suppression system is not required for the following structures and conditions.

1. Salt Dome Structures, Provided:

a. The structure is constructed with approved noncombustible material.

b. The structure is continually monitored by an approved automatic fire alarm system.

c. The structure is located a minimum distance of one-hundred (100) feet from any principle building, fueling facilities, and other high hazard occupancies or materials as defined in the adopted Building Code.

d. An approved water supply shall be available in accordance with Section 15.28.060 Water Supplies for Fire Department use.

2. Unenclosed Roof Structures:

a. The structure is constructed with approved noncombustible material.

b. The structure is located a mini8mum distance over one hundred (100) feet from any principle building.

c. An approved water supply shall be available in accordance with Section 15.28.060 Water Supplies for Fire Department use.

29. Delete the provisions of Section 903.3.1.2 “NFPA 13R Sprinkler Systems,” (pg. 168) in its entirety and substitute the following therefor:

903.3.1.2 NFPA 13R Sprinkler Systems. NFPA 13R Sprinkler systems are allowed only in one- and two-family dwellings; if provided, they shall be installed throughout in accordance with NFPA 13R.

30. Delete the provisions of Section 903.3.5.1.1 “Limited Area Sprinkler System” (pg. 169) and substitute the following therefor:

903.3.5.1.1 Limited Area Sprinkler Systems: Limited area sprinkler systems serving fewer than five (5) sprinklers on any single connection are permitted to be connected to the domestic service where a wet automatic standpipe is not available. Limited areas sprinkler systems connected to domestic water supplies shall comply with each of the following requirements:

31. Delete Exceptions No. 3 and No. 5 of Section 903.4 “Sprinkler System Monitoring and Alarms” (pg. 169) in their entirety.

32. Amend the provisions of Section 905 “Standpipe Systems” by adding the following:

905.11 Fire Department Connection: All required water extinguishing and standpipe systems shall be provided with a Fire Department connection in accordance with the applicable standards.

Exceptions:
1. Limited area sprinkler system supplied from the domestic water system shall not require a Fire Department connection.
2. This requirement shall allow the local Fire Department to approve a single connection for large diameter supply hose of not less than four (4”) inches inside diameter with appropriate adapting hardware.

33. Delete the provisions of Section 907.2 “Where Required” (pg. 174) and substitute the following therefor:

907.2 Where Required: An approved manual, automatic or manual and automatic fire alarm system shall be provided in accordance with Sections 907.2.1 through 907.2.23. Where automatic sprinkler protection, installed in accordance with Section 903.3.1.1 or 903.3.1.2, is provided and connected to the building fire alarm system, automatic heat detection required by this section shall not be required. An approved automatic fire detection system shall be installed in accordance with the provisions of this code and NFPA 72. Devices, combinations of devices, appliances and equipment shall comply with Section 907.1.2. The automatic fire detectors shall be smoke detectors, except that an approved alternative type of detector shall be installed in spaces such as boiler rooms where, during normal operation, products of combustion are present in sufficient quantity to actuate a smoke detector. Notwithstanding any provision of Section 907 to the contrary, an approved manual fire alarm signaling system shall be installed and maintained in all buildings over one (1) story in height or over 1,000 square feet.

34. Delete the Exception of Section 907.3.1 “Location” (pg. 179) in its entirety.

35. Delete the provisions of Section 907.14 “Monitoring” and its exceptions (pg. 180) and substitute the following therefor:

907.14 Supervisory Service: Where required by this chapter or the International Fire Code, an approved supervising station in accordance with NFPA 72 shall monitor fire alarm systems. All required fire protective signaling systems shall transmit alarm and trouble signs to an approved central station, proprietary system, or remote-station system, and shall be approved by the Fire Department. The following Methods are approved.
1. Direct connect
2. AES Radio
3. Or other methods approved by the Fire Official

Exception: Supervisory service is not required for:
1. Single- and multiple-station smoke alarms required by Section 907.2.10.
2. Smoke detectors in Group I-3 Occupancies

36. Amend the provisions of Section 909.1 “Scope and purpose” (pg. 181) by adding the following:

Section 909.1.1 Where Required: An emergency smoke control system is also required when one or more of the following applies:
1. In all sprinklered buildings with a gross (total of all floors) floor area of 40,000 square feet or more.
2. In all buildings over three (3) stories or thirty-five (35’) feet in height.
3. In buildings with multi-storied atriums.
4. In covered malls including anchor stores and tenant spaces.

37. Amend the provisions of Section 909.2 “General Design Requirements” (pg. 181) by adding the following:

909.2.1 Design Criteria: Mechanical or gravity venting may be utilized. Mechanical venting shall provide not less than six (6) air changes per hour, in addition to meeting the other criteria of this Section. Gravity venting shall conform to nationally accepted practices based upon the anticipated smoke production and cubic area to be vented. For ordinary hazards, gravity roof venting shall not be less than a 1:100 factor, and such vents shall be spaced not more than 120 feet on centers.

38. Amend Section 909.16 “Fire-fighter’s smoke control panel” (pg. 186) to read as follows:

909.16 A fire-fighter’s smoke control panel for fire department emergency response purposes only shall be provided and shall include manual control or override of automatic control for mechanical smoke control systems. The panel shall be located in a fire command center complying with Section 911, and shall comply with Sections 909.16.1 through 909.16.3. The location and design of controls for all smoke control systems shall be subject to the approval of the Fire Chief.

39. Amend the provisions of Section 1008.1.8.3 “Locks and Latches” (pg. 202) by deleting Conditions No. 2, 2.1, 2.2, 2.3 and 3.

40. Amend the provisions of Section 1008.1.8.5 “Unlatching” (pg. 202) by deleting item No. 3 of the Exception in its entirety.

41. Delete the provisions of Section 1008.1.8.6 “Delayed Egress Locks” (pg. 203) in its entirety.

42. Amend the provisions of Section 1008.1.8.7 “Stairway Door” (pg. 202) by deleting item No. 3 of the Exception in its entirety.

43. Amend the provisions of Section 1012.3 “Opening Limitations” by deleting the first paragraph and substituting the following therefor:

1012.2 Opening Limitations. Open guards shall have balusters or ornamental patterns such that a 4-inch diameter (102 mm) sphere cannot pass through any opening up to a height of 34 inches (864 mm). From a height of 34 inches (864 mm) to 42 inches (1067 mm) above the adjacent walking surfaces, a sphere 8 inches (203 mm) shall not pass. In occupancies in Groups A, B, E, I-1, I-2, I-4, M and R and in public garages and open parking structures, guards shall not have an ornamental pattern or design that would provide a ladder effect.

44. Delete the Exception to Section 1014.1 “Exit or Exit Access Doorways Required” (pg. 210) and substitute the following therefor:

Exception: Group I-2 occupancies shall comply with Section 1013.2.2. All Group H, I and R-2 occupancies shall provide two exits or exit access doorways from any space, regardless of occupant load or egress distance.

45. Delete Table 1014.1 “Spaces With One Means of Egress” (pg. 210) and substitute the following therefor:

47. Delete Section 1018.2 “Buildings With One Exit” (pg. 214) and Table 1018.2 in its entirety and substitute the following therefor:

1018.2 Buildings with one exit. Only one exit shall be required in buildings as described in Section 1014.1.

48. Amend the provisions of Section 1023.3 to read as follows:

1023.3 Exit discharge location. Exterior balconies, stairways and ramps shall be located at least 10 feet (3048 mm) from adjacent lot lines and from other buildings on the same lot unless the adjacent building exterior walls and openings are protected in accordance with Section 704 based on fire separation distance. Exit doors in exterior walls shall be provided and spaced not more than 150 feet apart.

49. Delete the provisions of Sections 1805.4.5 “Timber Footings” (pg. 366) and Section 1805.4.6 “Wood Foundations” (pg. 366) in their entirety.

50. Amend the provisions of Section 2308.8.2.1 “Engineered Wood Products” (pg. 473) by adding paragraph Section 2803.8.2.2 “I-Joist Frame” as follows:

2803.8.2.2 I Joist Frame. Floor and/or ceiling framing consisting of Engineered I-Joist shall have 5/8 Type X drywall placed at the underside of the joist with paper-tape embedded in compound over joints and covered in additional compound to provide protection of concealed space in accordance with 2002 Edition of NFPA 13, Section 8.14.1.

51. Delete the provisions of Section 3002.4 “Elevator car to accommodate ambulance stretcher” (pg. 551) and substitute the following therefor:

3002.4 Elevator car to accommodate ambulance stretcher. In buildings three (3) stories in height or more, at least one (1) elevator shall be provided for Fire Department emergency access to all floors. Such elevator car shall be of such a size and arrangement to accommodate a 24-inch by 76-inch (610 mm by 1930 mm) ambulance stretcher in the horizontal, open position and shall be identified by the international symbol for emergency medical services (star of life). The symbol shall not be less than 3 inches (76 mm) high and shall be placed inside on both sides of the hoistway door frame.

52. Delete the provisions of Section 3102 “Membrane Structures” (pg. 555) in its entirety.

53. Delete the provisions of Section 3103.1 “General” (pg. 556) and substitute the following therefor:

3103.1 General: The provisions of this section shall apply to structures erected for a period of less than 180 days. Tents erected for a period of less than 180 days shall comply with the International Fire Code. Those erected for a longer period of time shall comply with applicable sections of this code.

54. Delete the provisions of Section 3404.1.2 “Existing Fire Escapes” (pg. 567) and substitute the following therefor:

3404.1.2 Fire Escapes: Existing fire escapes shall be permitted as a component in the means of egress in existing structures in accordance with Section 1025.0 so long as such fire escape is properly maintained and provided that such fire escape shall be examined by a structural engineer who shall then submit a report as to such fire escapes fitness for use and structural integrity.

55. Delete the provisions of Section 3409 “Accessibility for Existing Buildings” (pg. 568) in its entirety. The design for accessibility shall comply with applicable provisions of the most current addition of the Illinois Accessibility Code and the Fair Housing Act.

56. Insert the date of August 1, 2004 in Section 3410.2 “Applicability.”

57. Amend the provisions of Section 3410.2.3 “Additions” (pg. 570) by adding paragraph Section 3410.2.3.1 “Fire Alarms Systems – Extension Installation” as follows:

3410.2.3.1 Fire Alarm Systems – Extension Installation: An existing fire alarm system shall be extended to provide protection to any additions to the building. If no fire alarm system presently exists, and the addition or additions individually or in aggregate exceed 200 square feet, an approved fire alarm system shall be installed throughout the entire existing building and addition(s) thereto.

58. Delete the provisions of Section 3410.6 “Evaluation Process” (pg. 571) in its entirety and substitute the following therefor:

3410.6 Evaluation Process: The results of the investigation and evaluation carried out under Section 3410.6 through 3410.9.1 shall be reduced to writing on a form generally similar to Table 3410.7 Summary Sheet – Building Score, and shall be made available upon request. As an objective evaluation conducted under the specific provisions of this Code, this document is not subject to appeal as provided elsewhere in this Code. Matters of applicability may still be appealed.

In applying this section to a building with mixed occupancies, where the separation between the mixed occupancies does not qualify for any category indicated in Section 3410.6.16, the score for each occupancy shall be determined and the lower score determined for each section of the evaluation process shall apply to the entire building.

Where the separation between the mixed occupancies qualifies for any category indicated in Section 3410.6.16, the score for each occupancy shall apply to each portion of the building based on the occupancy of the space.

Performance Guidelines for High Hazard Uses in the City of St. Charles

  1. Specific location: The geographic location and distances to other structures, rivers, streams, and other use groups.
  2. Zoning: The proximate distances to Assembly, Educational, Institutional, and Residential uses and vacant land zoned for these uses.
  3. Types of hazardous materials which are not allowed: Materials listed in Section 307.3 High Hazard Group H-1 that present a detonation hazard shall not be permitted under any circumstances.
  4. Allowable construction types: Type I and II only.
  5. Required fire protection for High Hazard materials:
    a. Provide extra hazard Group II fire sprinkler system
    b. Provide a fixed foam fire protection system
  6. Required water supply system: 3,000 to 6,000 gallons per minute from a reliable source.
  7. Required review of the maximum allowable quantities per the control areas and compliance with Sections 414, 415, 416, 417 and 418.
  8. Required review for potential for:
    a. Noise
    b. Glare and heat
    c. Vibration
    d. Dust or air pollution
    e. Odor
    f. Electromagnetic interference
    g. Water pollution and containment
    h. Hazardous waste and by-products
  9. Required safeguards provided for toxic substances
  10. Review of hazardous materials truck routes to and from the site.
  11. Elevation of product handling and transfer.
  12. Separation between high hazard areas and other use areas within the same building shall be provided by means of a four (4) hour rated reinforced solid masonry wall.
  13. Submittal and review of all hazardous materials MSDS.
  14. A specific evacuation plan is required for the building and surrounding area.
  15. A contingency plan is required for any spill or release of product to mitigate the hazard and provide a complete listing of persons to contact.”

15.04.020 One-family and two-family residences--Regulations adopted and modified.

The provisions of the 2000 International Residential Code for One and Two Family Dwellings, published January 2000 by the International Code Council, Inc., 5203 Leesburg Pike, Suite 708, Falls Church, Virginia 22041-3401 (hereinafter sometimes referred to as "the IRC"), not less than three (3) copies of which have been and are on file in the Office of the Clerk of the City of St. Charles, Illinois, for more than thirty (30) days, together with the amendments listed herein, are hereby adopted as the regulations governing the construction of one and two family dwellings and townhouses not more than three stories in height.

Amendments to the 2000 International Residential Code for One and Two Family Dwellings:

A. Chapter 1 - Administration:

1. Delete Sections R103 through R114 in their entirety, as the City has provided for the same under Chapter 15.101 "Administration, Enforcement, Fees, and Penalties" of the Municipal Code of the City of St. Charles.

B. Chapter 2 - Definitions:

1. Delete the definition of "BUILDING OFFICIAL" and substitute the following therefore: "BUILDING OFFICIAL. The Building and Zoning Commissioner of the City of St. Charles, or his designee."

2. Change the stated title of the "MANUFACTURED HOME" definition to "MANUFACTURED/MOBILE HOME."

3. Delete the definition of "TOWNHOUSE" and substitute the following therefore: "TOWNHOUSE. A single family dwelling unit constructed in a group of 3, 4, 5 or 6 attached units in which each unit extends from foundation to roof and with open space on at least two sides. Dwelling units where more than six units are attached shall be governed by code provisions applicable to multiple family dwellings, rather than the provisions of this one and two family dwelling code."

C. Chapter 3 - Building Planning:
