NOTICE OF PUBLIC HEARING
CITY OF ST. CHARLES SPECIAL SERVICE AREA NUMBER 72
NOTICE IS HEREBY GIVEN that on January 20, 2026, at 7:00 p.m. in the City Hall, Two East Main Street, St. Charles. Illinois, a hearing will be held by the City Council of the City of St. Charles to consider forming a special service area consisting of the territory generally described as Brooke Toria Estates Subdivision, all within the City of St. Charles, Kane and DuPage Counties, Illinois and legally described as:
A RE-SUBDIVISION OF LOTS 16, 17 AND 18 OF PETRUSKA’S SECOND SUBDIVISION, BEING A SUBDIVISION OF PART OF SECTION 30, TOWNSHIP 40 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, BEING DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 16, SAID CORNER BEING ON THE NORTH LINE OF THE NORTHWEST QUARTER OF SAID SECTION 30; THENCE SOUTH 56 DEGREES 12 MINUTES 48 SECONDS WEST ALONG THE NORTHWESTERLY RIGHT OF WAY LINE OF SMITH ROAD PER DOCUMENT NO. R1966-042231, 775.43 FEET TO THE SOUTHWESTERLY LINE OF SAID LOT 18; THENCE NORTH 33 DEGREES 44 MINUTES 26 SECONDS WEST ALONG SAID SOUTHWESTERLY LINE, 494.46 FEET TO THE AFOREMENTIONED NORTH LINE OF THE NORTHWEST QUARTER OF SAID SECTION 30; THENCE NORTH 88 DEGREES 45 MINUTES 03 SECONDS EAST ALONG SAID NORTH LINE, 919.33 FEET TO THE POINT OF BEGINNING, IN THE TOWNSHIP OF WAYNE, DUPAGE COUNTY, ILLINOIS.
The approximate street location is the Area bounded by:
A triangular area surrounding Faith Lane and bounded by Smith Road to the south; the corporate limit line between the City of St. Charles and the City of West Chicago to the north; and the development known as The Springs to the west.

The purpose of the formation of proposed Special Service Area No. 72 is generally to provide special municipal services which will benefit the area, specifically, the operation, maintenance, repair, rehabilitation, replacement and reconstruction of any stormwater management measures, major and/or minor stormwater system and/or special management areas; costs of design, engineering and other consulting services, surveying and permits, public liability insurance, and all administrative, legal and other costs or expenses incurred in connection therewith and with the administration of the Special Service Area (the “Services”), including the repayment of any loan or debt incurred for the provision of any of such Services, all of the Services to be in and for the Special Service Area and the Services are unique and in addition to the services provided the City as a whole.
At the hearing, there will be considered the levy of an annual tax, not to exceed an annual rate of 0.30 percent ($0.30 per $100.00) upon the property in the Special Service Area No. 72, based upon the assessed value, as equalized, of said property, for the purposes specified above. Said tax may be levied for an indefinite period of time following establishment of the proposed Special Service Area No. 72. A map of proposed Special Service Area No. 72 is on file in the office of the City Clerk and available for public inspection.
The proposed amount of the tax levy for the Special Services for the initial year for which taxes will be levied within the proposed Special Service Area No. 72 is $0.00 (zero dollars).
All interested persons, including all persons owning taxable real property located within proposed Special Service Area No. 72, will be given an opportunity to be heard at the hearing regarding the formation of and the boundaries of Special Service Area No. 72 and the proposed tax levy and may object to or file objections to the formation of the area and/or the amount of levy of taxes affecting said area.
The hearing may be adjourned by the City Council without further notice to another date without further notice, other than a motion to be entered upon the minutes fixing the time and place it will reconvene.
If a petition signed by at least 51% of the electors residing within the proposed Special Service Area No. 72 and by at least 51% of the owners of record of the real property included within the boundaries of the proposed Special Service Area No. 72 is filed with the City Clerk within sixty (60) days following the final adjournment of the public hearing, objecting to the creation of the proposed Special Service Area No. 72, the levy or impositions of a tax or a proposed increase in the tax rate, no such Special Service Area No. 72 as proposed may be created or enlarged, or tax may be levied or imposed nor the rate increased, except as otherwise permitted by law.
