NOTICE OF PUBLIC HEARING

CITY OF ST. CHARLES SPECIAL SERVICE AREA NUMBER 73

 

NOTICE IS HEREBY GIVEN that on January 20th, 2026, at 7:00 p.m. in the City Hall, Two East Main Street, St. Charles. Illinois, a hearing will be held by the City Council of the City of St. Charles to consider forming a special service area consisting of the territory generally described as Charlestowne Lakes Subdivision, all within the City of St. Charles, Kane and DuPage Counties, Illinois and legally described as:

ALL OF CHARLESTOWNE LAKES SUBDIVISION RECORDED AUGUST 2, 2023 AT DOCUMENT NUMBER 2023K026162 BEING A PART OF THE SOUTHEAST QUARTER OF SECTION 24, TOWNSHIP 40 NORTH, RANGE 8 EAST AND A PART OF THE NORTHEAST QUARTER OF SECTION 25, TOWNSHIP 40 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED AS FOLLOWS:

            The purpose of the formation of proposed Special Service Area No. 73 is generally to provide special municipal services which will benefit the area, specifically, the operation, maintenance, repair, rehabilitation, replacement and reconstruction of any stormwater management measures, major and/or minor stormwater system and/or special management areas; costs of design, engineering and other consulting services, surveying and permits, public liability insurance, and all administrative, legal and other costs or expenses incurred in connection therewith and with the administration of the Special Service Area (the “Services”), including the repayment of any loan or debt incurred for the provision of any of such Services, all of the Services to be in and for the Special Service Area and the Services are unique and in addition to the services provided the City as a whole.

            At the hearing, there will be considered the levy of an annual tax, not to exceed an annual rate of 0.40 percent ($0.40 per $100.00) upon the property in the Special Service Area No. 73, based upon the assessed value, as equalized, of said property, for the purposes specified  above.  Said tax may be levied for an indefinite period of time following establishment of the proposed Special Service Area No. 73.  A map of proposed Special Service Area No. 73 is on file in the office of the City Clerk and available for public inspection.

            The proposed amount of the tax levy for the Special Services for the initial year for which taxes will be levied within the proposed Special Service Area No. 73 is $0.00 (zero dollars).

            All interested persons, including all persons owning taxable real property located within proposed Special Service Area No. 73, will be given an opportunity to be heard at the hearing regarding the formation of and the boundaries of Special Service Area No. 73 and the proposed tax levy and may object to or file objections to the formation of the area and/or the amount of levy of taxes affecting said area.

            The hearing may be adjourned by the City Council without further notice to another date without further notice, other than a motion to be entered upon the minutes fixing the time and place it will reconvene.

            If a petition signed by at least 51% of the electors residing within the proposed Special Service Area No. 73 and by at least 51% of the owners of record of the real property included within the boundaries of the proposed Special Service Area No. 73 is filed with the City Clerk within sixty (60) days following the final adjournment of the public hearing, objecting to the creation of the proposed Special Service Area No. 73, the levy or impositions of a tax or a proposed increase in the tax rate, no such Special Service Area No. 73 as proposed may be created or enlarged, or tax may be levied or imposed nor the rate increased, except as otherwise permitted by law.
